OFFICIAL CONTEST RULES (KRQV)
The following describes the Official Contest Rules for the 92.9 The River Born to Win Giveaway (the “Contest”). Contest entrants must be eligible and qualify to win by satisfying the term, requirements, and conditions set forth below:
1. NO PURCHASE NECESSARY TO WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. OPEN TO LEGAL RESIDENTS OF THE STATE OF OKLAHOMA WHO ARE BETWEEN THE AGES OF EIGHTEEN (18) AND SEVENTY (70) AS OF THE DATE THEY ENTER.
2. SPONSOR: The sponsor of the Contest is Griffin Radio Tulsa, LLC (“Sponsor”), 303 N. Boston Ave., Tulsa, Oklahoma, 74103.
3. CONTEST FACILITATOR AND CONTEST OFFICIALS: The Sponsor shall also serve as the “Contest Facilitator” with responsibility for administering the Contest.“Contest Officials” designated by the management of the Contest Facilitator shall be responsible for interpretation and enforcement of the Contest Rules. Contest Officials shall have the right to disqualify any participant for violation of the Contest Rules and to resolve all disputes in their sole discretion.The Contest Facilitator reserves the right, in its sole discretion, to alter, change, cancel or suspend this Contest, for any reason whatsoever, without prior notification.
4. ELIGIBILITY: This Contest is open to all U.S. citizens and legal U.S. residents, between the ages of eighteen (18) and seventy (70) as of the date they enter, who reside in the State of Oklahoma, except as otherwise provided in these contest rules. Current or former employees of Sponsor, Odds On Promotions, and their designees or agents or their parent companies (including but not limited to Griffin Communications, LLC), affiliated stations or companies (including but not limited to News 9 (KWTV), News on 6 (KOTV), The Tulsa CW (KQCW), KSBI, 106.9 K-Hits (KHTT), 98.5 The Bull (KVOO), Big Country 99.5 (KXBL), and 92.9 The River (KRQV)), subsidiaries, divisions, and their advertising and promotional agencies and their respective officers, directors, and agents (collectively the “Contest Entities”) and the immediate family members and persons living in the same household of each, are not eligible to enter or win.
5. CONTEST PERIOD: The Contest begins at 7:20 AM Central Time (“CT”) on April 7, 2025, and ends at 7:00 PM CT on May 2, 2025, or when a Grand Prize winner has been selected, whichever comes first. The clock of the Contest Facilitator is the contest official clock.
6. HOW TO ENTER: During the Contest Period, participants must listen to 92.9 The River (KRQV) for the on-air cues-to-call, which will air at approximately 7:20 AM CT and 8:20 AM CT each weekday, (each a “round”). Each cue-to-call will contain the winning birth month for that round. Participants with the birth month announced in the cue-to-call for that round may call the phone number provided on-air to enter the Contest. The ninth caller in each round (the “On-Air Participant”) shall be placed on-air to provide their full legal birthdate. Full legal birthdate includes the month, date, and year of the On-Air Participant’s birth. The Contest Officials shall then compare the On-Air Participant’s full legal birthdate to the date generated by the Internet Contest Verification System, provided by Odds On Promotions, during that round. If the On-Air Participant’s full legal birthdate matches the date generated by the Internet Contest Verification System during that round, the On-Air Participant shall win the Grand Prize, subject to the other rules of this Contest.If the On-Air Participant’s full legal birthday does not match the date generated by the Internet Contest Verification System, no Grand Prize shall be awarded in that round.
7. WEEKLY AND GRAND PRIZE: An On-Air Participant that does not win a Grand Prize shall be entered into a weekly prize drawing for one $500 VISA Gift Card (the “Weekly Prize”), to be held each Friday during the Contest Period at 7:00 PM CT. One Weekly Prize winner shall be selected at random by the Contest Officials from the On-Air Participants from that current week.Weekly Prize winners shall be notified by telephone the following Monday. No more than four Weekly Prize winners shall be selected during the Contest Period. The Weekly Prize, or any portion thereof, is non-transferable, non-refundable, non-exchangeable and has no cash value. Contest Facilitator reserves the right to substitute the Weekly Prize with another prize due to prize unavailability.
The Grand Prize in this Contest is $92,900.00. Only one Grand Prize may be awarded in the Contest Period. The Grand Prize winner must be an On-Air Participant with a matching full legal birthdate to the date generated by the Internet Contest Verification System during that round. Full legal birthdate includes the month, date, and year of the On-Air Participant’s birth. The Grand Prize winner must provide their legal birth name, address, daytime telephone number, social security number, and driver’s license number at the time of winning. The Contest Facilitator reserves the right to require additional identification and may decline to award the Grand Prize based on falsification of identification, fraud, ineligibility, or other failure of the Grand Prize winner to comply with these Contest Rules.
In the event a Grand Prize winner is selected, the Contest Period shall end immediately. Any Grand Prize or Weekly Prize winner shall not be eligible to participate in or win any other contest or promotion hosted or conducted by the Contest Entities for thirty (30) days immediately following the date of winner is notified of their winning status.
8. PRIZE DISTRIBUTION, CONDITIONS, AND ODDS OF WINNING
All winners will be required to fill out a W9 and return it to the Contest Facilitator before the prize will be awarded. Winners have thirty (30) days from the time of being notified of their winning status to return their completed W9 to the Contest Facilitator. Failure to comply could result in the winner being disqualified and their prize revoked by the Contest Facilitator, with or without notice.
All winners must have a valid ID to claim their prize. Contest Facilitator reserves the right to require additional identification and may choose to deny awarding the prize based on falsification of identification, fraud, ineligibility, or other failure to comply with the Contest Rules.
In the event a Grand Prize winner is selected, the Grand Prize winner must also sign and return a Statement of Prizewinner, Official Rules, and 1099 Acknowledgment provided by Contest Facilitator. The signed documents, along with a copy of the Grand Prize winner’s driver’s license or birth certificate, must be received by Contest Facilitator within thirty (30) days of the Grand Prize winner's notification of their winning status. Failure to comply could result in the Grand Prize winner being disqualified and their prize revoked by the Contest Facilitator, with or without notice. Contest Facilitator reserves the right to require additional identification and may choose to deny awarding the prize based on falsification of identification, fraud, ineligibility, or other failure to comply with the Contest Rules.
The Grand Prize winner will be subject to a polygraph examination. Failure to comply or failure to pass the polygraph examination to the satisfaction of the Contest Officials could result in the winner being disqualified and their prize revoked by the Contest Facilitator, with or without notice.
All prizes may be revoked by the Contest Administrator under the additional following conditions: (1) a winner cannot be reached within twenty-four (24) hours of winner selection; (2) Contest Facilitator is unable to leave a voicemail due to a full voicemail box or because the mailbox is not properly set-up; (3) a winner does not return a phone call within forty-eight (48) hours of a message left by Contest Facilitator; (4) a winner is determined to be ineligible for the Contest; or (5) any other reason set forth in the Contest Rules.
9. TAXES AND COSTS RELATED TO PRIZES: All federal, state, or other tax liabilities (including income taxes), and subsequent or related expenses such as, but not limited to, gasoline, insurance, and maintenance arising from the award of a prize from this Contest will be the sole responsibility of each prize winner. In the event a prize winner receives, or has already received, a prize from any other contest(s) sponsored by Sponsor, Contest Facilitator and/or any of the Contest Entities, during the 2025 calendar year, such prize values will be combined with this prize value. Winner will receive a Form 1099 from Sponsor for total value of all prizes received during the 2025 calendar year.
10. GENERAL CONDITIONS: By participating in this Contest, all entrants agree (a) to abide by these and any additional specific official rules and the decisions of the Contest Entities and Contest Officials designated by Contest Facilitator, which will be binding and final in all respects; (b) to the use of information by the Contest Entities for marketing and advertising purposes as allowed by applicable privacy policies and law; (c) to indemnify, defend, and hold harmless the Contest Entities and their officers, directors, employees and agents from any and all liability, claims, lawsuits, costs, expenses, fees, injuries (including death), losses, and damages resulting or alleged to result from participation in the Contest, acceptance or use of any prize, and/or from entrants fraudulent or otherwise wrongful acts or omissions; (d) not to sue the Contest Entities for any damages alleged to arise from winner's acceptance of or use of the prize(s); and (e) to the use of the entrants, name, voice, biography, and likeness by Contest Entities without further notice or compensation for promotion, advertising, filing, and dissemination purposes, except where otherwise prohibited by law.
Contest Entities are not responsible for lost, late, damaged, misdirected, undelivered, undeliverable, incomplete, or unreadable entries. Contest Entities are not responsible for lost entries due to telephonic or electronic malfunctions. Contest Officials may prohibit an entrant from participating in the Contest or winning a prize if, in their sole discretion, it determines that said entrant is attempting to undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices or intending to annoy, abuse, threaten, or harass any other entrants or Contest Entities representatives. If for any reason this Contest is not capable of running as planned as a result of any causes beyond the reasonable control of Contest Entities including but not limited to tampering, unauthorized intervention or fraud which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Contest, then, Contest Officials reserve the right at their sole discretion to cancel, terminate, modify, or suspend the Contest. The rules can be modified at any time without notice.
11. DISPUTES: All entrants and Sponsor (together “the Parties”) agree that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Contest, or any prizes awarded, shall be resolved in the following manner: (a) Negotiation - The Parties first shall use reasonable efforts to discuss and negotiate a resolution of the controversy; (b) Arbitration. If the efforts to negotiate a resolution do not succeed, the Parties shall resolve the controversy by final and binding arbitration in accordance with the Rules for Commercial Arbitration of the American Arbitration Association (the “Rules”) and pursuant to the following additional provisions; (c) Applicable Law - The Parties agree that the internal laws of Oklahoma shall govern the construction of the terms and the application of the provisions of the Contest and that all disputes will be resolved in accordance with Oklahoma law; (2) Selection of Arbitrators - The Parties shall select one arbitrator within ten (10) days after the filing of a demand and submission in accordance with the Rules. If the Parties fail to agree on an arbitrator within that ten (10)-day period or fail to agree to an extension of that period, the arbitration shall take place before an arbitrator selected in accordance with the Rules; (3) Location of Arbitration. The arbitration shall take place in Oklahoma City, Oklahoma, and the arbitrator shall issue any award at the place of arbitration. The arbitrator may conduct hearings and meetings at any other place agreeable to the Parties or, upon the motion of a party, determined by the arbitrator as necessary to obtain significant testimony or evidence; (4) Enforcement of Award - The prevailing party shall have the right to enter the award of the arbitrator in any court having jurisdiction over one or more of the Parties or their assets. The Parties specifically waive any right they may have to apply to any court for relief from any decision of the arbitrator made prior to the award; (5) Attorneys’ Fees and Costs - The prevailing party to the arbitration shall have the right to an award of its reasonable attorneys’ fees, costs, and expenses incurred after the filing of the demand and submission.
12. LIMITATION OF LIABILITY/GOVERNING LAW. All entrants agree that by entering the Contest they waive any and all rights to claim actual, punitive, incidental, and consequential damages, and any other damages, against Sponsors and their designees or agents. All issues and questions concerning the construction, validity, interpretation and enforceability of these official Contest Rules, or the rights and obligations of entrants and the Sponsors and their designees or agents in connection with this Contest shall be governed by, and construed in accordance with the laws of the State of Oklahoma, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of Oklahoma or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than those of the State of Oklahoma. WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS CONTEST, INCLUDING THE PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
13. ONLINE STREAMING DELAYS. Due to delays in the online streaming of 92.9 The River (KRQV) broadcast signal, listeners to the online stream may not be able to participate in or may be disadvantaged in participating in on-air contests. Entrants are encouraged to listen to 92.9 The River (KRQV) on-air. 92.9 The River (KRQV) is not responsible for online streaming delays.
13. RIGHT TO USE NAME, VOICE, AND LIKENESS. By participating, all participants automatically grant the Contest Entities the right to audiotape and record their audio call-in. By winning, Grand Prize Winner automatically grants the Contest Entities unrestricted permission to use name, picture, and/or voice for website, on-air or other promotions.
14. NO AFFILIATION. This promotion is in no way sponsored, endorsed, or administered by, or associated with Facebook, MailChimp, Meta, or Instagram.
